Employment Law Update:

What’s New?

The Employment Equality (Age) Regulations will come into force in October 2006. The regulations are aimed at combating age discrimination in the workplace whether by age, age group or apparent age.

How will this affect me?

-Employers

You could be affected if you:

  • Demand an employee retires without having in place and giving consideration to procedures for reviewing whether or not the employee can remain within the workplace.
  • Advertise for a ‘young and dynamic’ or ‘mature and experienced’ employee
  • Allow employees to use discriminatory language (whether by to reference of age, sex or race)
  • Offer a salary based upon time served within your business such as service related perks and pensions

-Employees

You could be affected if you are subjected to any of the above behaviour whether by colleagues or your employer.

-Job-seekers

If you feel that you were refused a position due to your age the recruiter must show there was no age discrimination in their selection process.

What can I do?

Call us and we can advise you upon whether you have a valid claim. We can advise you on how to commence or defend proceedings brought in the employment tribunal or the county court.

PLEASE NOTE: A claim must be brought within 3 months (6 in the county court) of the act complained of…..so don’t delay call us now!!!!

There is no limit to the amount of compensation that can be claimed for a successful  age related claim.
